Atlas Service

These Terms and Conditions describe the use of atlas-servicegroup.com and the junk removal and hauling services offered by Atlas Service Group LLC ("Atlas Service Group," "we," "us," or "our"), based in Southern Indiana and serving the Kentuckiana area.

1. Application of These Terms

Please review these Terms before using our website or arranging services. The website provisions apply to your use of the website. The service provisions apply when we present these Terms to you and you accept them as part of your booking, estimate, or service agreement. Simply visiting our website or requesting information does not authorize work or create a payment obligation.

A written estimate, work order, or separate agreement accepted by both you and Atlas Service Group may include additional terms for your project. If those agreed terms conflict with these Terms, the project-specific terms control for that project, subject to applicable law.

2. Requests, Estimates, and Pricing

Submitting a website form or requesting an appointment does not guarantee availability or confirm a booking. We will confirm the service location, requested work, scheduling, and applicable pricing with you.

An estimate based on descriptions, photographs, or videos depends on the accuracy and completeness of the information provided. Unless identified as a fixed written quote, an estimate may require confirmation after we inspect the items and service conditions.

Pricing may account for the amount and type of material, weight, labor, access, travel, and disposal requirements. We will explain the price and any applicable charges before you authorize work. Added items, changed instructions, or unexpected conditions may require a revised price. We will obtain your approval before performing additional work or imposing additional charges.

3. Scheduling, Changes, and Cancellations

Arrival windows are estimates and may be affected by traffic, weather, earlier jobs, or other circumstances. We will make reasonable efforts to communicate significant delays and coordinate a new appointment when needed.

Contact us as soon as possible if you need to cancel, reschedule, or change the scope of work. Any deposit, cancellation, rescheduling, or unsuccessful pickup fee must be disclosed and agreed to before booking. These Terms do not independently establish such a fee. Deposits and refunds are handled under the agreed project terms and applicable law.

We may decline, postpone, or stop work when conditions are unsafe, required authorization is missing, prohibited materials are present, or the requested work cannot lawfully be performed. If we cannot complete the work, we will discuss any services already performed and any refund due under the agreed terms and applicable law.

4. Your Authority and Removal Instructions

You must own the items to be removed or have legal authority from the owner to authorize their removal. You must also have authority to allow us to enter the property and perform the requested work. Tell us about any ownership dispute, access restriction, or third-party interest before work begins.

Clearly identify the items to be removed and the items that must remain. Remove cash, jewelry, personal documents, medications, and other belongings you wish to keep before loading begins. An authorized representative must be available to approve the work unless we agree to written instructions for an unattended pickup.

Tell us immediately if an item was identified or loaded in error. We will make reasonable efforts to address the issue, but an item may be unrecoverable after donation, recycling, or disposal. This provision does not excuse our removal of items you did not authorize us to take.

5. Property Access and Service Conditions

Provide lawful, reasonably safe access to the work area and disclose stairs, narrow passages, parking restrictions, fragile surfaces, infestations, structural concerns, and other conditions that may affect the job. Keep children and pets safely away from the work area.

Appliances and fixtures must be safely disconnected unless disconnection is expressly included in the agreed scope and can lawfully be performed by our team. Demolition, structural alterations, utility work, and other specialized services require a separate written scope addressing any necessary permits, approvals, and qualified personnel. They are not automatically included in a junk removal booking.

6. Restricted and Hazardous Materials

Do not conceal hazardous or regulated materials among ordinary junk. We do not accept hazardous waste as part of standard junk removal. Examples include asbestos-containing materials, explosives, ammunition, radioactive materials, medical sharps, infectious waste, and hazardous chemicals.

Other items, including liquids, paint, batteries, tires, electronics, and appliances containing refrigerants, may be subject to special handling, facility restrictions, or additional charges. Describe these items in advance. We will confirm whether we can accept them and disclose any special arrangements or charges before you authorize the work.

7. Removed Items, Donation, and Disposal

When you authorize an item for permanent removal and we take possession of it, you authorize Atlas Service Group to transport, donate, recycle, dispose of, or otherwise lawfully handle that item. Unless a separate written agreement provides otherwise, you relinquish ownership of items accepted for permanent removal. This does not apply to belongings we agree to move or transport for return to you.

Donation and recycling depend on item condition, facility acceptance, and available options. We do not guarantee that a particular item will be donated or recycled, that a charity will accept it, or that a donation receipt or tax deduction will be available. We do not provide tax advice.

8. Payment

Payment is due according to the estimate, invoice, or service agreement you accept. Any required deposit, payment schedule, taxes, or other charges will be disclosed before authorization. Contact us before the due date if you believe an invoice contains an error.

We do not impose a late fee, interest charge, collection charge, or payment surcharge unless it is disclosed in the agreement you accept and permitted by applicable law. Electronic payments may also be subject to the payment provider's terms. Do not send full card numbers or account credentials through ordinary inquiry forms, email, or text messages.

9. Telephone, Email, and Text Communications

We may use the contact details you provide to respond to your inquiry and communicate about estimates, scheduling, arrival times, invoices, and service follow-up. Requesting service does not by itself enroll you in automated promotional text messages. Any promotional messaging requires the consent applicable law requires.

To stop text messages, reply STOP or otherwise ask us to stop, or contact us directly. You may unsubscribe from promotional emails using the option in the message or by contacting us. Message frequency varies, and carrier message and data charges may apply. Delivery may be affected by your carrier or communications provider. We will honor your preferences and arrange another way to communicate essential service information when needed.

10. Website Use and Intellectual Property

Use our website lawfully and provide accurate information. Do not impersonate another person, submit fraudulent requests, upload malicious code, attempt unauthorized access, interfere with website operation, or use the website to threaten, harass, or violate another person's rights. We may restrict access to address misuse or protect the website.

Our website text, designs, photographs, logos, and other materials belong to Atlas Service Group or their respective owners. You may view the website and retain information for your personal use or to evaluate our services. Reproduction, commercial reuse, or use of our branding requires permission unless applicable law allows it.

11. Third-Party Services and Website Availability

Our website may link to or include maps, videos, social media, reviews, payment tools, or other third-party services. Those providers operate under their own terms and privacy policies. A link does not by itself constitute our endorsement, and we do not control their independent content or operations.

We make reasonable efforts to keep website information accurate, but errors or interruptions may occur. General website information does not guarantee service availability or a particular price. To the extent permitted by law, the website is provided as available without a guarantee of uninterrupted or error-free operation. This website disclaimer does not reduce our obligations under an accepted service agreement.

12. Service Concerns and Responsibility

We will use reasonable care in performing the agreed work. Report a service concern or suspected damage promptly by phone or email, with photographs and relevant details if available, so we can investigate. Asking for prompt notice does not shorten a legal claim deadline or waive your rights.

We are not responsible for pre-existing damage or loss caused solely by conditions or events outside our reasonable control. To the extent permitted by law, neither party is responsible for indirect or consequential losses, such as lost business profits, arising from website use or service delays.

Nothing in these Terms excludes responsibility for our negligence, fraud, willful misconduct, bodily injury, or property damage, or limits a warranty, remedy, or consumer right that applicable law does not allow us to limit. Any limitation applies only to the extent it is lawful.

13. Privacy and Customer Materials

Our Privacy Policy explains how we handle personal information. You must have permission to submit any photographs, videos, or other materials you provide. We may use those materials to evaluate and perform your requested services. Permission to use images from your property in public advertising or on social media is requested separately; submitting an estimate request does not grant that permission.

14. Disputes and Governing Law

If a dispute arises, contact us so we can attempt to resolve it. Neither party is required to delay a legal filing or give up a remedy in order to contact the other party.

These Terms are governed by Indiana law to the extent permitted by applicable choice-of-law rules. Mandatory protections that apply to consumers or work performed in Kentucky or another jurisdiction remain effective. These Terms do not require binding arbitration or waive access to small claims court or other courts with jurisdiction.

15. Changes and General Provisions

We may revise these Terms by posting an updated version with a new Last Updated date. Revised service terms apply to future bookings when provided and accepted; they do not retroactively change an existing agreement without the parties' agreement. Website changes apply prospectively, subject to any notice or consent required by law.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. These Terms and the project terms you accept describe the agreement for their stated subject matter without eliminating any legally protected representations or rights.
